Sealing and Expungement for Lowell Criminal Records

People with criminal records in Lowell have two main options for limiting what appears in background checks: sealing and expungement. Both are available under Massachusetts law, depending on the specifics of the case.

Sealing hides a record from routine CORI checks. Under MGL c. 276 § 100A, you can petition to seal a misdemeanor record three years after the case ends and a felony record seven years after. Not all offenses are eligible. A sealed record still exists and courts and law enforcement can still view it. It just does not appear in a standard public or employer background check.

Expungement destroys the record entirely. Under MGL c. 276 §§ 100E-100U, expungement applies to cases that were dismissed, ended in a not guilty verdict, or involve certain youthful offender situations. Cases involving charges that were later decriminalized may also qualify. Once expunged, the record is gone and will not show up anywhere in a standard search.
