Sealing and Expungement

Massachusetts allows people to seal or expunge certain criminal records. The two processes work differently and apply to different situations.

Sealing under MGL c. 276 § 100A removes a record from public view but keeps it in the DCJIS system where law enforcement can still see it. You can petition to seal a misdemeanor conviction after 5 years and a felony conviction after 10 years. The waiting period begins at the end of the sentence, probation, or parole, whichever is later. Dismissed charges and not-guilty findings can often be sealed without a waiting period.

Expungement under MGL c. 276 §§ 100E-100U goes further. It destroys the record entirely. This option is narrower than sealing and applies mainly to first-time offenses that meet specific criteria, as well as records created when the person was a juvenile. You file the petition in the court where the case was originally heard. For Weymouth cases, that means the Quincy District Court or the Norfolk County Superior Court, depending on the charge.
